                                                          El borrador de
                                                          Ley de Urgente
                                                          Consideración
                                                          presentado por
                                                          el gobierno
                                                          electo que
                                                          asumirá el
                                                          próximo 1º de
                                                          marzo;<br>
                                                          <u>CONSIDERANDO</u>:
                                                          I) Que el
                                                          borrador de
                                                          Ley de Urgente
                                                          Consideración
                                                          contiene un
                                                          número
                                                          significativo
                                                          de artículos,
                                                          abordando
                                                          temas de
                                                          particular
                                                          relevancia
                                                          para el
                                                          desarrollo del
                                                          país; <br>
                                                                     
                                                                        
                                                                 II)
                                                          Que, además,
                                                          el texto
                                                          incluye una
                                                          serie de
                                                          modificaciones
                                                          a la Ley
                                                          General de
                                                          Educación (Nº
                                                          18437), a la
                                                          Ley Orgánica
                                                          de la
                                                          Universidad
                                                          (Nº 12549) y
                                                          al Sistema
                                                          Nacional de
                                                          Educación del
                                                          cual la
                                                          Universidad de
                                                          la República
                                                          forma parte; <br>
                                                                     
                                                                        
                                                                 III) La
                                                          importancia de
                                                          que los
                                                          actores
                                                          universitarios
                                                          se expresen
                                                          sobre los
                                                          asuntos de
                                                          interés
                                                          general para
                                                          la sociedad
                                                          uruguaya y en
                                                          particular
                                                          aquellos
                                                          relacionados
                                                          con la
                                                          educación; <br>

                                                          PREOCUPACIÓN
                                                          POR LOS
                                                          SIGUIENTES
                                                          ASPECTOS</u>:</span></font></font><br>
                                                          <font face="Arial,
                                                          sans-serif"><font style="font-size:12pt" size="3"><span style="font-weight:normal"></span></font></font><font face="Arial,
                                                          sans-serif"><font style="font-size:12pt" size="3"><span style="font-weight:normal"><br>
                                                          1) La
                                                          eliminación en
                                                          la Ley General
                                                          de Educación
                                                          de la
                                                          prohibición de
                                                          que el Estado
                                                          suscriba
                                                          acuerdos o
                                                          tratados,
                                                          bilaterales o
                                                          multilaterales,
                                                          con otros
                                                          Estados u
                                                          organismos
                                                          internacionales,
                                                          que directa o
                                                          indirectamente
                                                          signifiquen
                                                          considerar a
                                                          la educación
                                                          como un
                                                          servicio
                                                          lucrativo o
                                                          alentar su
                                                          mercantilización,
                                                          lo que es
                                                          contrario a
                                                          las
                                                          recomendaciones
                                                          internacionales
                                                          de UNESCO
                                                          IESALC de
                                                          considerarla
                                                          como un bien
                                                          público, tal
                                                          como ha sido
                                                          la tradición
                                                          de nuestro
                                                          país.<br>
                                                          2) La
                                                          supresión de
                                                          los espacios
                                                          de
                                                          coordinación
                                                          institucionales
                                                          entre los
                                                          organismos de
                                                          la educación
                                                          pública
                                                          sustituye la
                                                          responsabilidad
                                                          de
                                                          coordinación
                                                          establecida en
                                                          la actual Ley
                                                          de Educación
                                                          por una
                                                          voluntad
                                                          política
                                                          indefinida,
                                                          cuya
                                                          concreción
                                                          descansa en la
                                                          disposición de
                                                          las
                                                          autoridades
                                                          circunstanciales
                                                          del MEC, la
                                                          ANEP, la UTEC
                                                          y la UdelaR.
                                                          La atomización
                                                          resultante de
                                                          las
                                                          instituciones
                                                          de educación
                                                          pública
                                                          dificulta la
                                                          colaboración e
                                                          impide el uso
                                                          complementario
                                                          de los
                                                          recursos
                                                          educativos.<br>
                                                          3) La
                                                          desaparición
                                                          de ámbitos de
                                                          coordinación
                                                          específica
                                                          para los
                                                          actores de la
                                                          educación
                                                          pública y el
                                                          establecimiento
                                                          de nuevas
                                                          estructuras
                                                          que incorporan
                                                          con igual peso
                                                          actores
                                                          (públicos y
                                                          privados) con
                                                          muy diferente
                                                          peso relativo
                                                          e impacto
                                                          cualitativo en
                                                          la educación
                                                          nacional; y
                                                          donde la
                                                          representación
                                                          de la
                                                          Universidad de
                                                          la República
                                                          se hace en
                                                          forma
                                                          indirecta en
                                                          la mayoría de
                                                          los casos, o
                                                          se suprime en
                                                          otros.<br>
                                                          4) La
                                                          modificación
                                                          de la Ley
                                                          Orgánica de la
                                                          Universidad de
                                                          la República,
                                                          sin que
                                                          mediaran
                                                          instancias de
                                                          intercambio
                                                          previas con
                                                          las nuevas
                                                          autoridades
                                                          ministeriales,
                                                          trasladando la
                                                          potestad de
                                                          reconocer y
                                                          revalidar
                                                          títulos
                                                          emitidos por
                                                          instituciones
                                                          universitarias
                                                          extranjeras
                                                          hacia el
                                                          Ministerio de
                                                          Educación y
                                                          Cultura; sin
                                                          especificar
                                                          nuevos
                                                          procedimientos
                                                          y excluyendo
                                                          la reválida de
                                                          títulos no
                                                          habilitantes o
                                                          las reválidas
                                                          que requieren
                                                          pruebas
                                                          supletorias,
                                                          en perjuicio
                                                          de las
                                                          personas
                                                          inmigrantes.<br>
                                                          5) La
                                                          eliminación de
                                                          la
                                                          autorización a
                                                          los organismos
                                                          públicos para
                                                          contratar en
                                                          forma directa
                                                          con las
                                                          fundaciones o
                                                          asociaciones
                                                          instituidas
                                                          por la
                                                          Universidad de
                                                          la República,
                                                          que dificulta
                                                          la realización
                                                          de distintas
                                                          actividades de
                                                          transferencia
                                                          de
                                                          conocimiento y
                                                          asesoramiento
                                                          por parte de
                                                          la
                                                          institución.<br>
                                                          6) La
                                                          eliminación de
                                                          la
                                                          autorización
                                                          del mecanismo
                                                          de compra
                                                          directa a la
                                                          UdelaR, UTEC y
                                                          el IIBCE para
                                                          adquirir,
                                                          ejecutar,
                                                          reparar bienes
                                                          o contratar
                                                          servicios
                                                          destinados a
                                                          la
                                                          investigación
                                                          científica
                                                          perjudica la
                                                          calidad de la
                                                          investigación
                                                          académica y
                                                          condiciona los
                                                          proyectos de
                                                          desarrollo de
                                                          la
                                                          institución.<br>
                                                          7) La
                                                          habilitación a
                                                          las
                                                          universidades
                                                          privadas para
                                                          ser
                                                          contratadas en
                                                          forma directa
                                                          por los
                                                          organismos
                                                          públicos;
                                                          mientras que
                                                          se limita la
                                                          capacidad de
                                                          la Universidad
                                                          de proveer
                                                          servicios al
                                                          Estado dadas
                                                          las
                                                          modificaciones
                                                          señaladas en
                                                          el apartado
                                                          5),<br>
                                                          <br>
                                                          La Universidad
                                                          de la
                                                          República
                                                          expresa su
                                                          voluntad de
                                                          aportar a la
                                                          solución de
                                                          los problemas
                                                          que parecen
                                                          motivar los
                                                          cambios
                                                          propuestos en
                                                          el borrador de
                                                          la ley, en
                                                          particular la
                                                          construcción
                                                          de un Sistema
                                                          Nacional de
                                                          Educación
                                                          Pública y
                                                          solicita la
                                                          apertura de un
                                                          debate amplio
                                                          y profundo en
                                                          torno a estos
                                                          temas. <br>
                                                          <br>
                                                          La Universidad
                                                          entiende que
                                                          la
                                                          incorporación
                                                          de cambios
                                                          sustantivos
                                                          que afectan a
                                                          los diversos
                                                          aspectos de la
                                                          vida nacional
                                                          y muy
                                                          especialmente
                                                          al
                                                          funcionamiento
                                                          y articulación
                                                          entre las
                                                          instituciones
                                                          de educación
                                                          pública bajo
                                                          la figura de
                                                          ley de urgente
                                                          consideración
                                                          impone un
                                                          tratamiento
                                                          sumario que
                                                          condiciona el
                                                          intercambio
